2011 ? 2012 Michigan House and Senate ... - Real Estate 411

The 2011-2012 Michigan House and Senate legislative sessions have wrapped up, yielding some long-fought and well-earned legislative victories for the Michigan Association of REALTORS?. These victories are made possible by the dedication of REALTOR? members across the State:

Appraisal Management Companies-House Bills 4975 & 5271 were introduced in Michigan to be incompliance with federal financial reforms, which require state regulation of AMC?s. The legislation defines, regulates and set penalties for AMC?s operating in Michigan.

Building Inventory Tax Relief-This legislation provides property tax exemptions to inventory and spec homes in new developments. The new law provides new builds and inventory in development with a lower tax assessment until those properties are occupied.

Principal Residence Exemption-The new law alleviates those situations where a person may enter an assisted living facility, (with intentions of returning to their property), leaving their principal residence unoccupied and subject to a higher tax liability.

Principal Residence Enhancement Legislation-This fair, honest and sound property tax reform allows two dates for homebuyers to file for and receive their principal residence exemption, June 1st and November 1st. It also prevents foreclosures from losing their principal residence exemption, making it easier to qualify buyers and moving inventory.

90-Day Foreclosure Extension-The new law extends the 90-day foreclosure to June 30, 2013. This timeframe is important for homeowners as it allows them to meet with the lenders to try and work out a loan modification. It is anticipated that the new legislature will be looking to make changes to the State?s overall foreclosure process in the first 6 months of 2013.
Personal Property Tax Phase-Out-Legislation was passed by the Legislature providing the framework for the phase out of the PPT. This phase-out gives Michigan a clearer path for economic growth and moves the state up the ranks in terms of job competitiveness.
MSHDA Changes-Legislation was recently signed into law that keep the Michigan State Housing Developmemt Authority current and competitive with loan products available to low and moderate income homebuyers across the State.
Legislation Defeated-Occasionally, MAR must work hard to defeat legislation that is not in the best interest of its membership and/or the rights of private property owners. Legislation, which was aimed to exempt persons engaged in ?residential property management? from licensure as real estate brokers/salespersons, was defeated!

Apple withdraws patent claim against Samsung's Galaxy S III mini

Apple's patent claim against Samsung's Galaxy S III mini is no more, with Cupertino citing the phone's lacking availability in the US for the amendment to its original November filing. In the ongoing litigation between the two electronics giants, Samsung argued that it's Galaxy S III mini didn't warrant inclusion in the latest volley of Samsung devices Apple wants added to its patent lawsuit; Apple apparently agreed, and is thusly withdrawing its claim against that particular device. The argument also highlights the sad news that the S III mini won't join Samsung's Galaxy lineup in the US.

An agreement filing spotted by Reuters from a San Jose, CA. US District Court revealed today's news, coming just days after Judge Lucy Koh dismissed a request to permanently ban sales on several Samsung devices. It's unclear if the other Samsung devices Apple asked to be added to the ongoing case are approved yet by the court, but we can certainly count the S III mini out for the time being.

Asian stocks up ahead of U.S. fiscal cliff talks

BANGKOK (AP) ? Asian stock markets rose Friday, hours before President Barack Obama and key lawmakers were to meet at the White House to try to hammer out an 11th-hour budget compromise to avert the so-called fiscal cliff.

Lawmakers have until Monday night to hammer out a budget agreement before hundreds of billions of dollars in automatic tax increases and deep cuts to government spending kick in. Such a drastic reshuffling of money could throw the U.S. into another recession, economists have warned.

Failure to avoid the fiscal cliff doesn't necessarily mean tax increases and spending cuts would become permanent, since the new Congress could pass legislation canceling them retroactively after it begins its work next year.

Japan's Nikkei 225 index marched higher, hitting its highest level since March 20, 2011. The Tokyo benchmark rose 0.8 percent to 10,403.01.

Investors have been cheering newly named Japanese Prime Minister Shinzo Abe and his calls for more public works spending to reinvigorate the economy. He also wants the Bank of Japan to raise its inflation target from 1 to 2 percent to drag the country out of two decades of deflation, or steadily declining prices that have deadened economic activity.

Hong Kong's Hang Seng rose less than 0.1 percent to 22,653.86, while South Korea's Kospi added 0.3 percent to 1,993.48. Australia's S&P/ASX 200 gained 0.6 percent to 4,675.40.

Markets got some lift from optimistic data out of the U.S. and a statement from the German finance minister, Wolfgang Schaeuble, who said in an interview that the worst of the debt crisis in the 17 European Union countries that use the euro appears to be over.

In the U.S., the average number of people seeking unemployment benefits over the past month fell to the lowest level since March 2008, a sign that the job market is healing.

Worries over U.S. budget negotiations sent Wall Street slightly lower on Thursday. The Dow Jones industrial average fell 0.1 percent to 13,096.31. The Standard & Poor's 500 fell 0.1 percent to 1,418.10, and the Nasdaq composite index fell 0.1 percent to 2,985.91.

Benchmark oil for February delivery rose 39 cents to $91.26 in electronic trading on the New York Mercantile Exchange. The contract fell 11 cents to finish at $90.87 per barrel.

In currencies, the euro rose to $1.3245 from $1.3240 late Thursday in New York. The dollar gained to 86.43 yen from 86.02 yen.

Stress in the Legal System | Psychology Today

As I have written previously, jury duty can be stressful. Even in mundane cases, jurors are asked to perform a difficult, unfamiliar task in which they receive little guidance; and performing their civic duty disrupts their lives. Having been ?summoned,? they also have little choice in the matter, and there are potential penalties for failing to appear, though such penalties are rarely enforced. On the other hand, the vast majority of jurors who do serve find the process rewarding, and the stress and disruption they experience is relatively minor in all but the most extreme cases.

Other participants in the legal system are not so lucky. Many are there involuntarily?even less voluntarily than jurors?such as crime victims, civil and criminal defendants, those involved in family court, and witnesses. On top of the circumstances that gave rise to these individuals? involvement in the criminal or civil justice system, the process of investigation and adjudication can be an additional stressor. This is especially true for vulnerable populations like children, the elderly, and those with mental illness. For example, there are concerns that testifying in court can be every bit as traumatic for victims, especially child victims, as the crime itself.

Those who do choose to be involved?such as civil plaintiffs, attorneys, judges, law enforcement officers, and community supervision officers (i.e., probation and parole officers)?are also not immune from stress. Telltale symptoms, such as depression, anxiety, absenteeism, and cardiovascular disease, are prevalent in all of these populations. Because these individuals choose to be a part of the justice system, either for professional reasons or as a means to resolve a dispute, they might be said to have ?assumed the risk.? Nonetheless, for the system to work effectively and efficiently, it is imperative that it not create or add stress unnecessarily.

This is not to say that all stress can, or even should, be removed from the legal system. The courts make weighty, consequential decisions, and an awareness of that fact, along with the moderate level of stress that typically accompanies that awareness, is appropriate. But legal actors can still strive to maximize the positive physical, psychological, and social outcomes for all parties involved, while minimizing the negative outcomes. Doing so is the hallmark of therapeutic jurisprudence, which focuses on the legal system?s role as a therapeutic agent. It is the guiding principle behind the majority of ?specialty? or ?problem-solving? courts, which have been on the rise in recent years, such as special courts devoted to drug offenders, veterans, juveniles, and domestic violence. Although little data exist on the effectiveness of such courts, and what data do exist are mixed, their overarching goal of seeing that justice is served while simultaneously improving the situation of those involved?including offenders?is well worth pursuing. Therapeutic jurisprudence also informs efforts to accommodate vulnerable populations caught up in the justice system, such as children and the elderly (e.g., by using innovative techniques to make it easier for children to testify).

Stress is an unavoidable component of the legal system. The system poses a threat to participants? wellbeing, whether they are there by choice or not. It is incumbent on those who set legal policy to do what they can to minimize that stress, and thereby to foster the wellbeing of the myriad individuals who play a part, whether they are there as ?one-time players? (e.g., witnesses, jurors) or regular performers (e.g., judges, attorneys). To do otherwise would be, in a very real sense, unjust.

(AP) ? Survivors of a Christmas Day crash-landing of an airliner in Myanmar told terrifying tales of escape Wednesday as carrier Air Bagan apologized for what it called the worst accident since it started flying in 2004.

Details of the crash remain unclear but airline officials told a news conference Wednesday that they found the plane's two black boxes and were investigating what went wrong. So far, officials have blamed heavy fog for the aircraft's crash into a rice paddy field where it burst into flames. Two died and 11 were injured, including four foreigners.

The Fokker 100 jet was 21 years old but passed inspections at annual renewals of its air worthiness certificate, the officials said. On Tuesday, it was carrying 71 people, including 48 foreigners, from the city of Yangon via Mandalay to Heho airport, which is the gateway to the popular tourist destination Inle Lake.

"We felt the first bump, then a few big bumps and then (started) sliding very fast," said 31-year-old Australian advertising executive Anna Bartsch. Her boyfriend, Stuart Benson, described the landing like "a roller coaster" ride.

The plane came to a stop and they felt relief ? then panic.

"In my window I saw the flames, and it was hot and we knew straight away we didn't have much time to get out," Bartsch said during an interview at a Yangon hotel where the airline lodged passengers after evacuating them from the scene.

Passengers rushed up the aisle to the front door, which was initially stuck shut, she said.

"We didn't know then that the wings had come off," Bartsch said.

The door was quickly forced open and passengers raced from the plane, some in shock and some suffering smoke inhalation, she said. Once on safe ground, Bartsch said she saw the pilot and co-pilot with bloodied faces and other people with serious burns.

"It's amazing that the injuries were not more serious," she said. "It could have been much worse."

A flight attendant told reporters Wednesday that the crew realized something was wrong only when the plane hit the ground.

"We shouted, 'This is an emergency'," said flight attendant Khaing Su Naing, adding that despite one of the two doors initially getting stuck the crew evacuated the plane 90 seconds after it stopped moving.

The accident has raised concerns about the safety standards of Myanmar's overburdened airlines as foreign visitors have flocked to the Southeast Asian country which is emerging from a half-century of military rule.

Air Bagan is one of a half dozen private airlines that fly domestic routes in Myanmar. After one plane was destroyed in Tuesday's crash its fleet now consists of five planes, including four ATR turboprops and another Fokker 100, which is no longer made.

"We deeply apologize to all our passengers and to their family members," the airline's managing director Htoo Thet Htwe told the news conference. All passengers were paid $2,300, he said.

"This is the most serious accident Air Bagan has ever had," he said. In 2008, one of its planes overshot a provincial airport's runway, spun out of control and crashed, causing the wings and tail to snap off. Many passengers were injured but none died.

Air Bagan has said "the plane hit electrical cables about a mile (1.6 kilometers) from Heho airport as it descended and landed in rice fields."

The Information Ministry said the pilot mistook a road near the airport for the runway before stopping in a nearby rice paddy. It was unclear if the plane made its crash landing on the road or the rice field.

All fatalities were Myanmar citizens, including a man riding a motorcycle where the plane came down and a tour guide aboard the plane. There were earlier reports of an 11-year-old child also among the dead.

Ethanol Shot to the Heart Saves Man

A cardiologist in England gained international attention when he used an unconventional procedure -- a shot of basic alcohol to the heart -- to stop an unusual cardio rhythm in an elderly patient.

Dr. Tom Johnson, who carried out the procedure at the Bristol Heart Institute Hospital in Bristol, England, said Ronald Aldom, 77, was doing "fantastically well" after Johnson and his team used pure ethanol to treat Aldom's rapid heartbeat, a condition called ventricular tachycardia, or VT, about six weeks ago. VT, which starts in the lower two chambers of the heart -- the ventricles -- can be life-threatening if it goes untreated.

"He's got a lot of life to live," Johnson said.

It may seem like a story lifted out of "Pulp Fiction," but treating VT with ethanol, though rare, is an accepted method that has been used for years. What was noteworthy about Johnson's procedure was that he had never used ethanol to treat VT before, nor had it ever been done in that part of the United Kingdom.

"[Aldom]?was at a point where he felt he had no other option and was kind of facing death," Johnson said. "While it sounds like a very barbaric treatment, it was a very rewarding one, [but] very high risk."

Typically, a?radio frequency catheter ablation is the treatment choice for someone with VT.?A radio frequency catheter is an electrical probe that is threaded into the heart and uses low-voltage electricity to kill the heart tissue around the area causing the arrhythmia. This prevents the tissue from continuing to produce the abnormal rhythm.?

California Man Undergoes 'Breathing Lung' Transplant Watch Video

But Johnson said his colleagues had already tried that technique on Aldom, who had also previously endured heart attacks, without success -- scar tissue that forms after heart attacks can reject the electrical treatment.

"It was complicated by the fact that [Aldom] had severe damage to his heart already," Johnson said. "It got?to the point where this poor man was like, 'please shut it off and let me die.'"

Ethanol ablation?works in the same way in that it also selectively destroys heart tissue, but it?is more commonly used to treat hypertrophic cardiomyopathy, a condition in which the heart muscle is thick or "bulky," Johnson said. While he had used ethanol to treat?hypertrophic cardiomyopathy?before, to use it on Aldom was a last resort.

"This guy had no other option, which is why we were able to do something we had never done before," Johnson said.

The first step, Johnson said, was for him and his team to electronically map the heart to find and isolate the tissue that was causing the?abnormal rhythm. Once the problem artery was located, Johnson's team fed a wire into the vein graph and inflated a balloon to block the artery. Through that balloon, Johnson said they injected the ethanol while the patient was under anesthetic, killing off the problem tissue.

Destroying the tissue creates a controlled, "selective" heart attack, which can be painful, Johnson said, but it allows the heartbeat to return to normal.?

Using ethanol can have risky complications, Johnson said, because not only does it kill tissue, it can also kill some of the electrical function of the heart -- Aldom was already using a pace maker. Another risk, Johnson said, was that the balloon could shift, killing more tissue than intended. But his procedure came through successfully.

Dr. Richard Page, the chairman of the department of medicine at the University of Wisconsin School of Medicine and Public Health and a past-president of the Heart Rhythm Society in the United States, agreed that using ethanol to treat VT was "not a routine procedure at all."

Yeast species may cause differences in otherwise identical grapes from the same vineyard

Choosing the perfect wine may soon involve more than just knowing the perfect vintage and chateau. Differences in the microbes present on grapes even in different parts of the same vineyard may contribute to flavor fluctuations in samples of grapes from different tanks, according to research published December 26 in the open access journal PLOS ONE by Mathabatha Setati and colleagues from Stellenbosch University, South Africa.

"In the wine industry, the fungal communities on grapes are especially important. The microbial species present on the berry may contribute to the fermentation process, and therefore the aromatic properties of the resulting wine", the authors explain. For this study, the researchers sampled grapes from different vines in three well-established commercial vineyards, each of which used a different farming system - organic, traditional or biodynamic- to cultivate the grapes.

Across the three cultivation practices, they found that the same yeast species dominated in all vineyards, but the least treated vineyard had more variety of fungal species than the other two. They also found that within a single vineyard, small differences between vines, such as in temperature or sun exposure, could significantly alter the composition of the fungal community on grape surfaces. Setati adds, "Our findings could help viticulturalists and winemakers plan microharvest better, and implement better wine blending strategies to ensure consistency."

Anti-tax conservatives say no to tax-increase deal

BOSTON (AP) -- In the city where a protest over tax policy sparked a revolution, modern day tea party activists are cheering the recent Republican revolt in Washington that embarrassed House Speaker John Boehner and pushed the country closer to a "fiscal cliff" that forces tax increases and massive spending cuts on virtually every American.

"I want conservatives to stay strong," says Christine Morabito, president of the Greater Boston Tea Party. "Sometimes things have to get a lot worse before they get better."

Anti-tax conservatives from every corner of the nation echo her sentiment.

In more than a dozen interviews with The Associated Press, activists said they would rather the nation fall off the cliff than agree to a compromise that includes tax increases for any Americans, no matter how high their income. They dismiss economists' warnings that the automatic tax increases and deep spending cuts set to take effect Jan. 1 could trigger a fresh recession, and they overlook the fact that most people would see their taxes increase if President Barack Obama and Boehner, R-Ohio, fail to reach a year-end agreement.

The strong opposition among tea party activists and Republican leaders from New Hampshire to Wyoming and South Carolina highlights divisions within the GOP as well as the challenge that Obama and Boehner face in trying to get a deal done.

On Capitol Hill, some Republicans worry about the practical and political implications should the GOP block a compromise designed to avoid tax increases for most Americans and cut the nation's deficit.

"It weakens the entire Republican Party, the Republican majority," Rep. Steven LaTourette, R-Ohio, said Thursday night shortly after rank-and-file Republicans rejected Boehner's "Plan B" ? a measure that would have prevented tax increases on all Americans but million-dollar earners.

"I mean it's the continuing dumbing down of the Republican Party and we are going to be seen more and more as a bunch of extremists that can't even get a majority of our own people to support policies that we're putting forward," LaTourette said. "If you're not a governing majority, you're not going to be a majority very long."

It's a concern that does not seem to resonate with conservatives such as tea party activist Frank Smith of Cheyenne, Wyo. He cheered Boehner's failure as a victory for anti-tax conservatives and a setback for Obama, just six weeks after the president won re-election on a promise to cut the deficit in part by raising taxes on incomes exceeding $250,000.

Smith said his "hat's off" to those Republicans in Congress who rejected their own leader's plan.

"Let's go over the cliff and see what's on the other side," the blacksmith said. "On the other side" are tax increases for most Americans, not just the top earners, though that point seemed lost on Smith, who added: "We have a day of reckoning coming, whether it's next week or next year. Sooner or later the chickens are coming home to roost. Let's let them roost next week."

It's not just tea party activists who want Republicans in Washington to stand firm.

In conservative states such as South Carolina and Louisiana, party leaders are encouraging members of their congressional delegations to oppose any deal that includes tax increases. Elected officials from those states have little political incentive to cooperate with the Democratic president, given that most of their constituents voted for Obama's Republican opponent, Mitt Romney.

"If it takes us going off a cliff to convince people we're in a mess, then so be it," South Carolina GOP Chairman Chad Connelly said. "We have a president who is a whiner. He has done nothing but blame President Bush. It's time to make President Obama own this economy."

In Louisiana, state GOP Chairman Roger Villere said that "people are frustrated with Speaker Boehner. They hear people run as conservatives, run against tax hikes. They want them to keep their word."

Jack Kimball, a former New Hampshire GOP chairman, said he was "elated" that conservatives thwarted Boehner. He called the looming deadline a political creation. "The Republicans really need to stand on their principles. They have to hold firm."

Conservative opposition to compromise with Obama does not reflect the view of most Americans, according to recent public opinion polls.

A CBS News survey conducted this month found that 81 percent of adults wanted Republicans in Congress to compromise in the current budget negotiations to get a deal done rather than "stick to their positions even if it means not coming to an agreement." The vast majority of Republicans and independent voters agreed.

Overall, 47 percent in the poll said they blamed Republicans in Congress more than Obama and Democrats for recent "difficulties in reaching agreements and passing legislation in Congress." About one-quarter placed more blame on the Democrats and 21 percent said both were responsible.

Although negotiations broke down last week, Obama still hopes to broker a larger debt-reduction deal that includes tax increases on high earners and Republican-favored cuts to entitlement programs such as Medicare and Social Security. If a compromise continues to prove elusive, lawmakers could pass a temporary extension that delays the cliff's most onerous provisions and gives Congress more time to work out a longer-term solution.

That's becoming the favored path by some Republicans leery of going over the cliff.

Mississippi Republican Chairman Joe Nosef shares his Southern colleagues' disdain for tax increases. But he stopped short of taking an absolute position.

"I really, really feel like the only way that Republicans can mess up badly is if they come away with nothing on spending or something that's the same old thing where they hope a Congress in 10 years will have the intestinal fortitude to do it," he said.

Matt Kibbe, president of the national organization and tea party ally, FreedomWorks, says that going over the cliff would be "a fiscal disaster." He says "the only rational thing to do" is approve a temporary extension that prevents widespread tax increases.

But his message doesn't seem to resonate with conservative activists in the states.

"If we have to endure the pain of the cliff then so be it," said Mark Anders, a Republican committeeman for Washington state's Lewis County. "While it may spell the end of the Republican Party ... at least we will force the government to cut and cut deep into actual spending."

Back where the Boston Tea Party protest took place in 1773, Morabito wonders whether Boehner will survive the internal political upheaval and says Republicans need to unite against Obama.

"It looked like from the very beginning they were just going to cave to what President Obama wanted," she said of the GOP. "I didn't want that to happen. Now I'm hopeful that they're standing up for tax-paying Americans."

Plotters of school killings tend to tip off someone in advance

It was the Connecticut school massacre that never happened.

A 16-year-old junior was stockpiling guns in his bedroom closet for an attack on April 10, 2007. In a red folder on his nightstand, he kept a map of his high school in the town of Newington, a hit list of more than 20 classmates, a timeline of a killing plan that ended with his own suicide, and photos of Dylan Klebold and Eric Harris of Columbine infamy.

But Frank Fechteler never had the chance to carry out his plot; a girl had caught word of the planned attack and told her parents and the police.

Rampages such as the one this month at Sandy Hook Elementary School in Newtown, Conn., invariably raise the question of how the shooters might have been identified in time to prevent their deadly assaults.

There is no psychological profile specific enough to pinpoint school shooters in advance. But one common thread may offer the best opportunity to intercept them: They tend to be indiscreet during their planning stages. The difference between a tragedy and a tragedy averted, experts say, is often somebody who knows something deciding to speak up.

Ironically, the security measures instituted by many schools after the 1999 Columbine High School massacre in Colorado may discourage students from sharing potentially life-saving information. Metal detectors, cameras, increased police presence and indiscriminate disciplinary policies, at their worst, can create a culture of mistrust and silence, researchers said.

"Kids are less likely to come forward if they perceive an authoritarian stance," said Eric Madfis, an assistant professor of criminal justice at the University of Washington branch in Tacoma.

It is unclear whether Adam Lanza, the 20-year-old loner who killed 20 first-graders and seven adults before turning a gun on himself, had revealed his plans to anybody. There is little research on whether adult mass murderers are prone to what criminologists refer to as "leakage."

But a 2004 report by the U.S. Secret Service and the Department of Education found that teenage shooters tend to talk.

The study examined 37 attacks on schools dating to 1974. In 81% of those cases, at least one other person ? typically a friend, classmate or sibling ? had some prior knowledge of the event. In 59% of the cases, more than one person knew.

In a follow-up report, bystanders who had remained silent told researchers that they worried about adults overreacting if the information turned out to be wrong.

Killing schemes have been revealed after the plotters unsuccessfully tried to recruit other students, bragged about their plans or warned friends to stay home on a particular day.

Fechteler's 2007 plot against Newington High School in Connecticut was broken up two months before he was to carry it out.

The unidentified girl who spoke up testified in a sworn affidavit that a boy she knew and his friend "Frank" had been talking about an attack on the school since December 2006. After the boy sent her links to YouTube videos of Fechteler shooting rifles and setting off explosives, she felt threatened enough to tell her parents.

Fechteler, who had no history as a troublemaker, pleaded guilty to making threats and a bomb and was sentenced to three years in prison.

Psychologists can characterize rampage shooters only in broad terms.

The typical perpetrator is a white male who lives in a tightknit suburb or rural area, where life can be especially difficult for people who don't fit in. He has been bullied. He suffers from depression or another psychiatric disorder and is deeply frustrated with his life, blaming others for his miseries. He begins planning his crimes after a loss that feels catastrophic ? a job or a girlfriend, for instance.

And he has easy access to semiautomatic firearms.

While that description is accurate, it's not very useful.

"There are hundreds of thousands of students who fit the profile of the school shooter and wouldn't hurt anybody," said Jack Levin, a Northeastern University sociologist and criminologist who studies mass murder.

Iran president's press adviser returns to prison

TEHRAN, Iran (AP) ? Iran's official news agency says the president's press adviser has returned to prison after being on a four-day medical leave granted by judicial authorities.

Monday' report by IRNA says Ali Akbar Javanfekr went back to Tehran's Evin Prison to continue serving his six-month sentence for "publishing material contrary to Islamic norms" and insulting Supreme Leader Ayatollah Ali Khamenei.

The charges are believed linked to President Mahmoud Ahmadinejad's political battles with Khamenei.

Ahmadinejad visited Javanfker in hospital on Sunday in a gesture of support for the adviser. The adviser was in stable condition.

An Iranian court convicted Javanfekr in 2011 and banned him from journalism activities for three years.

FLICKR IS FREE! - Business Insider

Marissa Mayer just did something amazing.

The CEO of Yahoo just made Flickr free?for three months, anyway.

The photo-sharing site is now making its unlimited Pro service, normally a paid subscription running $25 a year, free for three months. Existing subscribers get an extra three months free.

The practical effect of that is that Flickr users, especially new ones turned off by Instagram's ever-changing terms of service and attracted by Flickr's new iPhone app, don't have to worry about the crazy, nearly decade-old limits on photo sharing that have crippled the service.

Did you know, for example, that free Flickr users are limited to seeing the most recent 200 photos they've posted?

It's a tragic story: Yahoo had a chance to own photo sharing on the Web when it bought Flickr in 2005 (for a price that was reportedly about 0.03 Instagrams).

Back then, Flickr had found a clever way to support itself: Selling Pro subscriptions, which appealed especially to amateur and professional photographers who were willing to laboriously upload high-resolution photos to the site.

And back then, servers and bandwidth were expensive. So the restrictions made sense as a way to separate casual users who might scan and upload a few photos here and there from the hardcore fans willing to pay for unlimited photo storage and other perks. It was a classic example of what's now called the "freemium"?free and premium?business model.

Today, computing power is ultracheap, and cameras are in every mobile device. As a result, Facebook brought photo sharing to the masses with a crucial people-tagging feature, while Instagram turned every smartphone owner into an obsessive hobbyist photographer. Flickr's been frozen that whole time. But now it has a chance to make a big leap.

So from here we can see two things happening:

  • Yahoo sticks with the freemium business model, using the three-month free trial to lure a bunch of users to Flickr and convert at least some of them to Pro subscriptions, boosting revenues.
  • Yahoo uses the three-month period to test how much it really costs to offer Flickr completely for free, and either eliminates the Pro fee altogether or substantially lifts the limits on free users after March. The result: A service which can handle the higher-resolution photos produced by the latest generation of smartphones, and which is far better designed for displaying large, gorgeous photos and sharing them all over the Web, not just on cramped phone screens.

Your move, Marissa.

The Wall Street Journal finally comes to Newsstand

?

The Wall Street Journal finally comes to Newsstand

It took a long while, but The Wall Street Journal has finally come to Apple's iOS Newsstand. The paper joins thousands of other publications that are publishing via the magazine/newspaper service, and like many, the Journal's gone for a traditional layout that echoes that of the dead tree version. That said, the Newsstand distribution of the Journal is significantly more flexible than its paper cousin, offering full-screen image viewing, three text sizes, social network sharing options (that frustratingly don't use the built-in iOS sharing and require separate authorizations), and faster navigation between articles. It's not quite the authentically-digital that is The Magazine, but it's better than the PNG/JPG images that many publications are unfortunately vomiting into Newsstand.

The app uses a traditional newspaper-style layout, putting the headlines and preview ledes for multiple stories on a single page with an assortment of thumbnail images as well as larger stand-alone photos and videos (the only way you're getting video with the paper version is by using it as a massive flipbook). Navigation between pages of both the article preview grids and within the articles themselves is accomplished with a simple swipe to the left or right, though you'll have to contend with numerous fullscreen ads interspersed throughout. Apparently the $12.99 the paper asks per month for an iPhone subscription or the $21.99 a month they want if you want full access on an iPad (which also includes iPhone and website access) isn't enough to cover their needs, though it is worth noting that's the same price the Journal charges outside of the App Store system, and through Newsstand Apple's going to be taking a 30% cut. Additionally, the pinch gesture works as a back command, dropping you out of the article and into the previews, and from there to the 'start screen'.

As is standard for Newsstand subscriptions, the latest daily edition of The Wall Street Journal will download itself in the background. The Newsstand edition of the Journal also allows you to save articles for offline reading and offers up-to-the-second stock quotes and market news - it is The Wall Street Journal, after all. Many of the articles throughout the app are marked with little key icons, indicating that you're going to need a paid subscription to read them. There are still plenty of articles that aren't locked down, though those are mostly general news you can get anywhere and not the in-depth market and economic reporting for which the Journal is known.

By accepting the 30% cut demanded by Apple, The Wall Street Journal is acknowledging that they need to be present in full on smartphones and tablets like the iPhone and iPad. You're welcome to balk at the monthly cost of the subscription (especially if you're wanting to read the Journal on an iPad, as the same content is offered to smartphone users, it's just... smaller), but that's increasingly becoming the rule when it comes to 'old' media making the transition to new platforms.
